What is eDiscovery?
eDiscovery is the process of presenting evidence that is relevant to the cause at hand in litigation. It is the “electronic” portion of Discovery in litigation. Prior to the use of computers in personal and corporate applications, Discovery solely involved the collection, copying and production of documents to the opposing party and court in litigation. This process often involved dozens of bankers boxes of documents being wheeled into a courtroom by attorneys. With invention and prolific use of computers and various data storage devices the way people communicate and store information has morphed from landline phone calls to email and from typed documents stored in filing cabinets to electronic documents stored on hard drives or online.

To deal with this change the much needed Federal Rules for Civil Procedure (FRCP) were updated to include electronically stored information (ESI) into the Discovery process. Hence the term eDiscovery (Electronic Discovery). Because the court had no way to verify the authenticity of an electronic document or communication event, the FRCP required the use of a qualified Computer Forensic Expert to collect the data in a forensically sound manner and control the transfer of that data between the parties and eventually the court, in a manner that could be forensically verified and repeated by an opposing expert.

Is eDiscovery Expensive?
The expense of eDiscovery can be greatly affected by your choices. The cost of all eDiscovery professional services will clearly vary depending on the size and complexity of the case. The improper use of a Vendor to provide Processing, Hosting and Review services can become extremely expensive. These Vendor services are useful when used in document production requests but are of very little to no value on matters that require investigation into potentially nefarious activity by an individual or individuals.

This is why LCG is NOT a Vendor and DOESN’T provide Vendor related services (one of the very few in the nation). LCG knows the Vendor process produces little to no relevant investigative results and that when it is used for this purpose, eDiscovery becomes EXTREMELY expensive and the end client never gets the results they deserve.

By including LCG in the eDiscovery strategy, LCG experienced investigative experts can find the absolute best “smoking gun” evidence quickly and efficiently, while a Vendor can focus on providing the privilege review and production services that their tools were designed for.

Any company that tells you that a Vendor can produce the same level of evidentiary results that LCG is offering is unequivocally LYING. LCG could increase its annual revenue by 10x minimum just by offering these Vendor related services, but the enticement to sell those services over the investigative services would be too great and not in our client’s best interest. At LCG, we put ETHICS over profiting at the expense of our Client’s case.
